Actually, in most all states you can still receive unemployment if you were fired as long as it was not for "cause" . What happens is, you file. The employer responds with a "no, I fired him" and then you have a telephone conference or and in person conference with the unemployment agent assigned to you...Unless you did something to be fired, such as stealing, just not showing up, etc... you will still get it. In this type of situation you will get the unemployment.

I work for a law firm that represents employers in unemployment insurance matters. The best thing to do is to contact your state unemployment department, even if you have quit. Keep in mind that state unemployment insurance departments are very much in favor of you, not the company. If you don't get unemployment, you have not lost anything.

Thanks for the info on unemployment. I will look into it. I am currently on my state's disability program. My GYN thought I could stay on it even if I quit my job. Does anyone know anything about that?

I don't know for sure but it would not surprise me. California has a lot of state laws that are very pro-employee.

RosieMe, you need to contact the California Labor Board, find out if they can just tell you they don't want you back until your 100% or if they have to offer you a no lifting position, I believe if your Dr. releases you back to work with restrictions they must accommidate you or say they can't and if they can't then your dissability insurance will continue to pay you. If you quit you can stay on disability but not on unemployment, you want to keep the job because if they terminate your employment you can also collect unemployment, if you have also been there for a year or more look into FMLA. My husband was able to take off 3 paid weeks after my surgery through FMLA too. If you have been there for a year or more, they must hold your job. I would not quit no matter how long it takes, you should not have to go out job hunting after all that! You can find a lot of information on the California Labor Boards web site, if you don't see what your looking for get the phone number off that site and give them a call.
