Any HR people out there? Lay-offs while on disability.

Due to a work force reduction plan, I am most likely going to be laid-off during the time I am on disability for my LAVH. Wow. Does anyone know the legalities of this? Do they have to wait until I come back, or can they just say "don't come back". Can I transfer over from collecting disability to unemployment? Help!

Just what I needed , but at least I have a little warning.

Hi KatieScarlett68!

It's a shame you have this extra concern thrown into the works as a pre-op hysterectomy patient.

I think it would be best if you contacted your own state's Department of Labor to ask the questions you posted here. Laws vary from state to state. You would want "official information" about this issue, after all.

Sorry to hear that you may have an employment issue.

Unfortunately, if you are in a "hire and fire" at will state, you may have o recourse.

As far as disability to unemployment, check with your state. Also, understand, the way your employer codes their dismissed can affect your benefits. They will, most likely, do all that they can to deny unemployment benies.

I'm sorry you have to worry about your job also. I don't know if the FMLA is local or on a federal level, but that is something you might want to look into. It is called the "Family Medical Leave Act". This is supposed to protect you with your job if you need to take off work due to a medical reason for yourself or a family member. You might want to research this.

To be covered by the FMLA (a federal law, by the way), your employer has to have 50 or more employees, unless it is an educational facility. There are also some other requirements in the Family Medical Leave Act. You might want to vist the Department of Labor's website.

I'm not an expert, but I believe that you cannot collect both unemployment and disability. In my state of Alabama, you must be physically able to work during periods of unemployment in order to collect compensation. It might be different where you're located.
