I got to thinking of the discussions about employers not wanting employees to take off for surgery; wanting employees to work while at home; or wanting employees to come in for a few hours a day, and I looked up the sight on Family and Medical Leave.

Certain employers MUST allow you up to 12 weeks of unpaid leave for a "serious medical condition". It's the same act that provides maternity/adoption leave.

Check it out if you are having problems with your employer!

Thanks for the info. The place where I work doesn't fall into the FMLA because we don't have enough employees We only have 12 and I believe you need 15. We lost one of the gals at work because she had her hyst It's SO UNFAIR :cry:

You actually need 50 employees that work within 50 miles of one location. So if you have 60 but they are all over the U.S. they don't have to offer FMLA.

Yes, the law does say 50 or more employees, but I found nothing about what geographical area they must cover. Sounded to me like any company with 50 or more employees is included.

The Family & Medical Leave Act (FMLA) applies to your company if you employ over 50 employees within 75 miles of the worksite, and at least 50 of your employees work 20 or more work-weeks in the current or preceding calendar year. If your company is a public agency, you are subject to provide FMLA regardless of the number of employees employed. All schools, private or public, are considered public agencies.

OH, OK! I see now

The Dept. of Labor site mentioned nothing about distance when talking about what employERS were covered, but when it got into describing covered employEES, it did say within 75 miles!

My bad, I stumble when I read Legalese!
