attempted to return to work

I attempted to return to work this morning! Once my boss got there she called me into her office and laid me off. So along with all of the pain and suffering I am now unemployed. My six weeks was up Friday. I guess they realized they no longer needed me, my position was eliminated!

Ah that's really bad, after what you've just been through too.
ARe they employers allowed to do that, it doesn't sound right to me.
I returned to work after 10 weeks and we've been told there are 5 redundancies coming up, so everyone is a little bit worried at the moment, won't find out what's happening until may.
What do you do....will you be able to find another job??
Keep smiling and take it easy until you find something else.

They are an "At Will" employer, I guess this means they can do what they want.

You don't list your location in your profile info under your name there, but I have a suggestion.

If you're in the States, contact your local unemployment office. There may be a period of time that is considered a reprisal if your employer lets you go right after a medical leave. I'm sure with medical expenses from your surgery, the last thing you want to think about is a court case...it may be worthy of a call to an attorney in your area that does free consultations just to find out if there's something there.

I understand about "employment at will", but your recent leave may complicate the situation in your favor because of the Family Medical Leave Act. I'm sure it doesn't sound like much comfort, but at the very least they won't be able to dispute an unemployment claim.

I agree with the last post. The Family Medical Leave Act (FMLA) protects you from situations like this. An employer cannot terminate you for taking medical leave. Please call your HR for more information...

Just to be sure, I cruised around on the Department of Labor website - it says you have the right to be restored to the same position as prior to your leave. According to their clarifications, you can only be laid off or terminated if the company is going to do away with your position - in other words are others doing the same job as you being let go at the same time? If it's just you, and there are others that do your same job, then you have recourse against them.

Definitely be in touch with either state or legal representation about this!
