Surgery Date 6/10, still no word from Employer on FMLA approval....

I notified my supervisor 1month and 1 day in advance of my surgery. Written memo with copies (and copies of my doctors note) respectfully requesting that the 8 weeks be FMLA leave. I believe I have to notify him at least 30 days prior, if possible.

Two weeks have gone by, and he STILL has not spoken with his boss about this leave. Well, I have about two weeks left to work.

My question is, do I have to worry about it? I know they can't deny me the leave (I am also protected by a union contract), but can they make it uncomfortable for me when June 10 comes? in 1997 when I used this leave, I had no problems with my former boss(s) (same employment).

Am I just wigging out for nothing? Sure, add this to the cramps and pain. People wonder why I'm ready to go postal.

PS - PLUS I work in an all male environment. Yippee. I swear, just give them one month with a period... never mind the complications. Then watch this be approved for total disability... LOL.

Your lucky you get a FMLA, I don't, my surgery date is the same as yours and they have already hired a girl to take my place for six weeks, I'm training her now. I feel like they don't think I'm coming back. I also have a glich because I have to have a bladder scope on Wed. that will confirm the surgery date, long story, I mentioned what if my surgery is post poned? and I got a look and they said they already hired someone. Like I really want this TAH/BSO postponed. I don't think so. I don't get paid either. I work in a four girl office. Keep me posted.

My thoughts will be with you... I am fortunate, I will be able to collect TDI (temp disability Ins).

There is really no one to take my place.... I work in a police department... LOL.

I feel for you. I would mention it to him again or go to someone either in H.R. or from the union about it. Whenever I have mine done, I will have the time off paid under my disability leave/short term minus the 1st eight days. But I would have to wait until at least July 13 to have it done in order to have my job safe while I am gone since I have not work for my company for 6 mos yet.

I've taken FMLA during each of my surgeries. Sometimes I was able to give the 30 day notice thing, other time I could only give a couple of weeks. Each time my first contact was with my supervisor, but after that I dealt only with human resources. At my company it is my responsibility to ensure the paperwork gets filled out, not by boss. You may want to speak to your HR representative.

You've got the upper hand and the law on your side for this one. Both before surgery and after.
