Fmla

Does anyone know when the FMLA kicks in? My husband and I both completed a form. We sent them in around June 8th. I had my hysterectomy on June 15th. How does this FMLA work anyway?

I never had to deal with FMLA so I don't have any words of wisdom for you but there is an article about it on the Pre-Op Articles page that explains it.

I work for a huge corporation so my process might be different than yours.

I initially had to notify HR that I wanted FMLA via a web based form. I then printed out the forms to take to my doctor so she could fill them out and I faxed those to HR and am still waiting for the ‘okay letter’ I called dozens of times and I guess it must be okay because I still can log on to work.
They delivered something fed-x a few days ago but my wonderful puppy chewed it up I guess that was the okay letter. I called and they will send it U.S. mail this time, still not sure if that is what it was. Great HR, large corporation, no one cares much.
Anyway so after you request whatever time your doctor specified (mine is six weeks) you either need to submit a release to work (from the doc) or a request for more time off.

Your FMLA will kick in as soon as you are not able to work.
It should keep your absense from causing you any problems with your work.
It allows you to have time off of work that you need.
It works different from short term disability, though, if you have that also.

I dont FMLA covers an employee under any kinda of pay if you take off to care for a family member, is it?

FMLA itself does not provide any income during time off.. What it does is save your job and allow you to take the time off without any penalties.
Short Term/Long Term Disability Insurance is what will actually pay you for time off of work from your surgery..
check with your HR department to see if you have anything like that.

What state are you in? I'm in California and just submitted my claim form to EDD. The first two weeks of my leave, I use my vacation accrual from work, then EDD payments kick in. You get a certain % of your paycheck from EDD. Under FLMA in California, you're entitled to 12 weeks job protected leave. FMLA leave is only job protected leave, you get paid from EDD....from the state. Hope that helps!

Unfortunately, only 5 States and the Commonwealth of Puerto Rico provide or require employers to provide short-term disability insurance benefits. They are California, Hawaii, New Jersey, New York and Rhode Island.

FMLA not only saves your job, but also provides you with medical benefits. However, it will not pay any income for you. My FMLA came in from day of surgery until my return to work in 6 weeks. Before surgery I submitted a letter from my doctor stating I am scheduled for procedure with expected recovery time 6 weeks and HR approved FMLA. Since I had enough sick/vacation time accural to cover all 6 weeks, I was getting my full pay all this time. Otherwise, I had to apply for short-time disability that pays certain % of your pay. Before my return, I had sent a letter from my doctor that I am OK to go back.

I turned my paperwork for short-term disability a week before my surgery on 6/12 and I got my approval in the mail yesterday 6/18. My FMLA would be approved regardless because of the medical procedure. I work for a county government.
