How long have you worked for this lawyer? Is there more than 50 employees in your office?
I would certainly seek out a professional opinion (most lawyers will do free consult to see if you have a case) you may have a case depending on your state.

kmoc....I don't think this creep CAN fire you. Even if you don't qualify for FMLA....I would think this is TOTALLY illegal! I would contact an attorney asap.

I am the only employee in the office and have been with him not quite a year and a half. I think his c.y.a. is that he never said I was fired, but it seems to me that it was implied... Does that sound like I was fired ??? I live in a small Texas town and have told a couple of my friends who work for the DA's office and one of the judges here. I am going to give myself another week (surgery was Jan.24) and see what my options are. I know that I cannot file for unemployment until I am able to work. I just wanted SnoSpud to know that I am behind her 100% and my thoughts and prayers are with her. I went to Idaho when I was a teenager and threaten to run away to Idaho about once a month.

Ohmigod, what an awful, thoughtless way for employers to treat people.

Stress can definitely impact on the healing process.

Snospud, definitely let your brother handle this communication, and keep copies of all the e-mail stuff (if you weren't already).

Kmoc, did you keep the message? Record it if you can, with all the particulars of how you got it, and how it was handled.

Hard to forget this kind of stuff, but try to keep focused on healing. {{{hugs}}}

Hello,
I also had a TAH (1/4/05), am 33yrs old, and am at home just trying to recover. My heart goes out to you and your situation. I could not even imagine a boss like your's who has gone to such extremes to hinder your healing process. You need this time to recover and heal and it amazes me how unsupportive your boss is being during this difficult time. I really think they stepped over the line when they called the doctor's office and requested medically sensitive information regarding your situation. I know that would be breaking the HEPA law we have here in NY.
That's all I can say is stick to your guns, and remember you and your health comes first!
